Can an Employer that receives the Paycheck Protection Program loan receive the Employee Retention Credit as well? 

  • No, the provisions do not allow for an employer to receive the Employee Retention Credit if the employer also receives the PPP loan.

Under the aggregation rules we are treated as a single employer. If one of the entities received a Paycheck Protection Program loan does that mean all entities of the aggregated group are ineligible for the Employee Retention Credit?

  • Yes, as an employer treated as a single employer under the aggregation rules, the remaining entities would also be ineligible for the Employee Retention Credit.

After an employer’s Paycheck Protection Program loan is forgiven are they eligible to receive the Employee Retention Credit? 

  • No, if the employer has received the PPP loan they are not eligible to receive the Employee Retention Credit.

Can employers receive the Employee Retention Credit and the paid family medical leave credit (IRS Section 45S)?

  • Yes, however the employer cannot claim the Employee Retention Credit and paid family and medical leave credit on the same wage payments.

Can employers received the Employee Retention Credit and Work Opportunity Tax Credit (WOTC) for the same period?

  • No, both credits cannot be claimed for the same period of time.
